Disputes, Hearings, and Litigation
Our firm works closely with our clients to counsel them on the most effective means of resolving disputes. We provide litigation services, in and out of court, including disputes with other cannabis entities and ancillary businesses; cannabis regulatory and administrative violations; real estate, land use, and environmental disputes; and general contract and business disputes. More specific examples include:
- Litigation against violations in defense of your licensed cannabis business
- Administrative hearings regarding denial, suspension, or revocation of your cannabis license
- Civil litigation of zoning compliance issues
- Litigation of contract disputes
Washington State LCB Enforcement
The Washington State Liquor Control Board (WSLCB or LCB) is the state government agency in charge of the drafting and implementing cannabis regulations, issuing cannabis licenses, and enforcing the regulations as applied to licensed entities. The WSLCB has created strict and broad-reaching regulations, such as ownership and financing requirements, minimum security requirements, advertising restrictions, traceability or anti-diversion requirements, and many other requirements intended to comply with federal guidance on state marijuana operations. It is important to understand that Washington State law does not preempt federal law, and still today, individuals involved in the cannabis industry can be subject to federal prosecution. However, federal prosecution is unlikely due to existing federal policies and congressional requirements, but we ensure our clients remain well-informed and well-advised to avoid any undue issues.
